Arbor Ridge Home Owners Association Meeting September 27th 2010

Attendance: Mike F., Aditya K., Sunil L., John M., Lynda D. from TMG

Homeowner Input: Tom a homeowner was inquiring about a $11,000 irrigation expense. He explained that he has seen several sprinkler heads that were miss-aimed, or broken shooting water into the street over the summer and wants to know what the landscaping service more or less ignored those issues for several days and weeks over the summer. Mike F. explained that these and other issues were being addressed currently.

Arbor Ridge Home Owners Association Meeting was called to order at 7:50pm

Meeting Minutes: Minutes from the special meeting in June were approved by motion from Sunil L.

President’s report: Landscape walk with Mike F., Mary D., Lynda D., and John from Showplace landscaping was done and issues were noted by Mike and Lynda. Also please see the write up from Mary D., Carolyn and Amie
2 board member positions are going to be available this coming election – 3 year terms and a board member at large position is also open.

Treasurer’s Report: Nothing to report at this time

Committee Reports:

Architectural Committee: One door color change request that was approved.
Social Committee: Ice cream social went off well but the turnout was less than the year before.

Management Report:
a: Mailbox issue. There have been complaints that the mailboxes are getting moldy and dirty so there was a quote done for cleaning the mailboxes.
b: 16581 Oak Creek – Papers piling up – No Board issue here.
c: 17094 NW Elk Run – Lawn issue – Good detailed response for a plan of action – No Board issue
d: 17150 NW Oak Creek – Mold issue on the house – No Board issue
e: 16976 NW Mesa View – Dirt beside fence between homes, home owner is making a compose area – No Board issue.

Financial Report: Overall issues are improving and there are less delinquencies

New Business:
1. Reserve Study – Board briefly went over the Reserve Study and agreed that a on-site should be done in the next two years.
2. 2011 Budget – Board discussed the 2011 budget and made adjustments to both the Cottage Collection and Main Collection budgets. The Cottage Collection budget was motioned for approval by John M. and seconded by Sunil L. The Main Collection was discussed at great length to make it balance out for the 2011 year. Budget for the Main Collection was motioned for approval by Sunil L. and seconded by John M. The budget for 2011 will keep the current assessment of $250/yr for the 2011 time frame.
3. Landscape Study – Board went over the new landscape plan to convert several between property driveway grass triangles to convert to a more manageable ground cover solution. Phase I is to convert from Oak Creek North up to West Union. Board approves moving ahead with this plan at this time.
4. Mailbox Cleaning – Bid went out to have the mailboxes cleaning – Costs were bid out to $30/hr or $512.50 for the project. Motion to approve this plan to clean the Mailboxes and not to exceed $1,000 and to buy 4 slow children permanent signs on sign post for the community was motioned by John M. and approved by the board.
5. A short Newsletter for the general election and Fall will be put together and sent out ASAP

Arbor Ridge Home Owners Association Meeting July 12th 2010

Attendance: Mike F., Cathy P., Sunil L., Aditya K., John M. , Lynda D. from TMG

Call to Order: 7:07pm

Homeowner input: There were no homeowners in attendance this evening.

Meeting Minutes: Approval of meeting minutes for Board meeting held on May 24th 2010 and Arbor Ridge HOA special meeting held June 21st 2010. Cathy P. motioned to accept both meeting minutes for May and June with no changes.

President’s report: No report for this meeting

Treasurer’s report: Lynda D. provided Sunil L. with a copy of the 2009 Financials from the CPA firm of Williamson and Associates.

Committee Reports:

ARC Committee – two applications are currently in the committee for consideration.

Social Committee – Ice cream social is scheduled for August 21st and Cathy is asking for volunteers to help divide up the work needed to get the event off and running.

Newsletter – Thoughts of designing a new newsletter and highlighting the need for more community participation and other community related topics was discussed. Also the idea of bringing some local advertising to help offset mail costs was talked about.

Landscape committee – Mary was not in attendance this evening however we did get a general report out from Carolyn B that Mary was going to contact John at Showplace about issues with the current spring work on the cottage homes. Several homes were noted having poorly trimmed bushes and shrubs by Showplace.

Also a dead tree was identified during the last walkthrough and should be removed and not replaced. Cathy P. noted that there are several trees on Laidlaw and other locations on the property that have branches drooping and broken which may cause issues with traffic and don’t have a good appearance. Also more graffiti has been noted on the property fences.

Management report –

Administration –Most issues are non-board related just reminders to homeowners.

Financial – 16904 NW Oak Creek Dr is trying to get a $75 fine removed. The Board has already motioned to keep the fine. 4185 NW Chapparral Tr. Will be waved since this is a first time fine. And the homeowner has taken care of the issue.

Repairs and Maintenance –Bark dust is having some delays but some has been distributed. Fence cleaning will be cleaned after bark dust is distributed. And the seal coating on the private drives will also be done this season. Discussion on notifications and warning signs for homeowners on theses private streets was discussed.  The company will be asked if they have signage to warn the homeowners.

Unfinished Business – Sign Resolution was discussed at great length, a synopsis of that discussion will be documented here. There were some edits to the sign resolution and those edits will be forthcoming as an addition to the minutes. The one major change is that rental signs will only be allowed in the residence windows on the main floor.  No signs will be allowed outside the home.  Motion to approve the sign resolution once the edits were in place by Cathy P. and seconded by Sunil L.  As of July 2010 the current signage cases pending for rental signs will be waved and TMG will notify these homeowners of this information ASAP.

New Business – Board resignation that was submitted by Tom W. in an email and was approved by John M. and passed with a 3-1 vote.

Compliance reporting will continue through TMG process with TMG doing the inspections.

Special Meeting on Arbor Ridge community signage June 21st 2010

Meeting Called to order 7:01pm

Homeowner input:  – Fewer signs the better was one suggestion from a homeowner. One homeowner stated that directional signs should be allowed for open house sales and garage sales.

Unfinished Business –

Points of Review –

1.       CC&R’s do not define all Types of possible signs

2.       The board cannot make any decisions on signs other than For Sale or Political signs without being challenged legally.

3.       A Resolution was recommended by the assigned attorney to advise how to fill in the gaps.

4.       We currently have home owners in limbo on assessed fees based on the outcome of the board decision on signage.

5.        Questions of type of signs, For Rent, No Soliciting, scoop after your pet, Garage and yard sales, have been brought in the recent meeting either as a violation or by home owners.

6.       If the board does nothing then the board has no option but to ignore signs other than For Sale or Political signs, this can leave the board open for other issues.

The board took the revised sign resolution working document and made the first round of changes to the document.

ARBOR RIDGE HOMEOWNERS’ ASSOCIATION

ADMINISTRATIVE RESOLUTION NUMBER xxxxx

Signs, Notices and Aesthetic Appearance – Common Areas and Private Lots (Properties)

WHEREAS, The Arbor Ridge Homeowners Association Board of Directors according to the By-Laws, Article 7, Section 1 is given the “power to adopt and publish rules and regulations governing use and maintenance of the Common area…and to establish fines and penalties for the violation thereof.”; and It appears that there is a mixture of items related to common areas and other areas that are privately owned. It would seem that the purpose would be better served if those categories were grouped in order to avoid any confusion in the minds of the readers.

WHEREAS, the Planned Community Act, ORS 94.630(1)(a) and ORS 94.640(1), the Board may adopt rules and regulations for the Planned Community in general, not inconsistent with the Declarationor Bylaws; and WHEREAS, Pursuant to Declaration Section A-6, Signs, No signs shall be erected or maintained on any lot (Excluding Arbor Ridge Entry Monument Signs) except that not more then one “For Sale” sign placed by the owner, Declarant or by a licensed real estate agent, consistent with controlling governmental ordinances, may be temporarily displayed on any lot. This restriction shall not prohibit the temporary placement of “political” signs on any lot by the owner; and WHEREAS, it is the intent of the Board of Directors to regulate the use of signs and other items which affect the aesthetic appeal of Arbor Ridge neighborhood.

NOW, THEREFORE, BE IT RESOLVED THAT the following rules shall apply:

1. No freestanding real estate signs, open house signs or directional signs are to be placed anywhere along Laidlaw Road and West Union Road or at the entries to Arbor Ridge along Laidlaw Road or West Union Road, with the exception of the Arbor Ridge Home Owner Meeting Signs. All signage must be removed at the end of the day. Signs may only be displayed during “open house” hours.

2. A single real estate sign can be located on the lot itself, with the sign being located in the middle of the front yard near the street side lot line. Under no circumstances shall a sign be allowed on a side or real lot line or backyard. The maximum size of this approved sign is 18″ x 24″ and must be suspended or attached from a signpost. Sale and resale signs and posts must be removed within five days of closing of Signs, Notices and Aesthetic Appearance – Common Areas and Private Lots (Properties) the sale.

3. All signage within Arbor Ridge directing people to homes outside Arbor Ridge will be removed immediately without notification and discarded.

4. The Association shall retain the right to remove unauthorized signs without notice and/or require the lot owner to remove the sign(s)

5. No signage is to be placed in building windows. The only exceptions to this rule are Neighborhood Watch, Security, No Soliciting, Block Home or Religious and Holiday signs which must be commercially created signs that are professional in look and feel. No hand made signs will be allowed and should not exceed the size of 12″ x 12″.

6. Rental signs may be posted only on the private property where the rental is located and must conform to the real estate sign requirements for signs on lots. Rental signs and posts must be removed within five days of closing of rental, and no directional signs may be used.

7. Garage/Yard sale signs, personal signs, announcements, and other display materials are not allowed other than the day of the event . These types of signs are not permitted in the common areas along Laidlaw Road or West Union Road, with the exception of the Home Owner Association Annual Neighborhood sponsored Garage Sale Bannersunless it is the day of the event.

8. Security signs are permitted on private lots; however, the signs should be as close to the building as possible. To prevent challenges it might be better to phrase this as “To allow for maximum personal safety and security, security signs are permitted…”.

9. House numbers painted on street curbs should be stenciled professionally with black lettering on white background and not be taller than the height of the curb and no longer then 15″.

10. Commercial signs, general notices and other signs are not permitted in Arbor Ridge except as authorized elsewhere in the Association’s general rules and regulations. Vendor may place a 1 sign on the homeowners lot with the homeowner’s permission to advertise the company/work being done during the time the work on the home is being performed.

11. Advertisement signs for any purpose of generating business are not permitted on any Common Areas Signs, Notices and Aesthetic Appearance – Common Areas and Private Lots (Properties) and Private Lots.

12. Requests for exceptions to the sign rules may be submitted in writing to the Association’s Management Company office for review and consideration by the Association at the next Board Meeting. Such exceptions requests shall identify the type of sign to be used and the size, location, and intent of such use, in order that the Board may fairly evaluate the request for an exception.

13. Nothing herein shall be construed in such a way as to be applied or used to discriminate on the basis of race, religion, national origin, or other Constitutional or Federally or State Protected right afforded by law.

Arbor Ridge Home Owners Association Meeting May 24th 2010

Homeowner’s Input:
Brian Smith Homeowner near 174th and Laidlaw, Spoke about the graffiti issue and that kids are playing in the wetland area near the bridge during school hours. Kids playing with “airsoft guns” shooting at each other.

Todd from Tuscon St. addressed the board about the large No Solicitation sign installed on there front door that is clearly seen from the street. The homeowner was explaining the issue when he was told that we will cover his and other issues at the special signage meeting in June.

Desert Canyon – landscaping issues from homeowners complaining that the front yard bushes are getting hacked up by the landscapers and the homeowners want more control over how the landscaping is done. And the automatic watering system is over watering the yards and homeowners want more control over how much watering is done.

Any announcement on bark dusting this year? Homeowners want notification on when the barkdust will be replaced. Suggestion was to have sandwich boards out that look like the community meeting sandwich boards that the HOA uses.

Meeting called to order at 7:36pm

Hearing on 17310 Lapaloma Dr. – Tree removed and replaced. Homeowner is asking that all the fees be dropped. The homeowner seemed to be merging two issues into one. There was a landscaping issue and a street tree issue. The tree has been replaced but this took several months to happen. Also the landscaping issue has been going on for three years. The board agreed to a landscaping plan that is to be submitted in two weeks from the date of this meeting. There was no discussion by the board to repeal any fines that have accrued over the three years of non-compliance.

4. Shrub pruning and replacement – Mary requests that a document for the description of how, what, where, shrubs are to be and replacement rules etc.

Motion on fence washing and seal coating –

Max budget of 3,900 on Fence washing and a Max budget of 4,500 on the seal coating.

Management report –

In summary for the management report all fines assessed on each issue were held and other warnings were noted. If the issue was covering signage, those issues will be worked out after the special meeting that will discuss issues of signage on the property. Please see the attached Management report for details on each issue.

Delinquency report –

Discussion over the properties most delinquent that have been forwarded to Smith and Greaves have yielded some conclusions.

16746 NW Oak Creek Drive  and 4316 NW Moon Valley Terrace the owner has moved to New Jersey and it to peruse this issue will be very costly. The attorneys recommend closing this issue. $5802.87 outstanding

Repairs and Maintenance –

Bark Dust map was dropped off at Tom W. house – John M. Scanned and mailed the map out to the board.

Lynda will speak to John at Showplace about bark dust notifications.

Treasurer’s Report: Sunil L. will email an overview of the Columbia Bank information for the board at a later date. For minutes purposes the basics are that the majority of banking will remain with US Bank. What will be moved to Columbia will be the reserve funds so they can have a .8% return on those funds in the form of a money market.

Compliance will result in waiving the current fines. This motion was seconded and approved by the board

Trim on and around garage door was painted black by the previous owner – New owner has submitted an ARC on the issue – No further action will be required.

Financial: Not covered this evening other than Sunil’s Columbia bank information

Repairs & Maintenance: Showplace has an estimate of $14,300 for installation and placement of new bark dust in the cottage collection and $4,300 for new bark dust in the common areas. In discussion about this service it was determined that a Statement of work should be submitted to John at Showplace. Cathy P. proposed a motion to create a statement of work with pictures and once this is submitted and agreed upon then Showplace may begin this work. This motion was seconded and passed by the board. Further Cathy P. and Aditya K. will liaise with John at Showplace to go over the statement of work.

*Lynda – The board would like to get a full diagram of the grounds covered by the cottage collection and the Master association so the board knows where the bark dust areas are located.

Sidewalk repairs for the cottage collection will be for 29 homes is $3,600 – Cathy P. motioned to approve this repair and it was seconded – Board approves this motion.

Unfinished Business: Sprinklers have been checked and batteries have been replaced, they are ready for the season.

Solar Panel installation – discussion about the panel placement and upkeep

New Business: Meeting length was discussed and TMG will start charging if meeting exceed 1.5hrs. Notably a timer was requested to help keep meeting time to a reasonable level.

It was agreed that repair of the white rail fence at the corner of 174th and Laidlaw should be undertaken as soon as possible.  Cathy is to get an estimate of the cost to replace from spare parts and report to the Board.

Arbor Ridge Home Owners Association Meeting March 29th 2010

Homeowner Input –

16642 NW Tucson St. Homeowner is upset that he has received 9 friendly reminders in 2009 would like the reminders to stop. Homeowner is waiting till spring to install the new landscaping.

4398 NW Palmbrook Dr. Homeowner is not understanding the $174 fine, And there were several questions about the reserve fund. Mike was asked to put an explanation on the website.

16599 Oak Creek Dr. Part of the meeting this evening, the homeowners were asked to wait till the meeting.

4656 NW Union Hills Dr. $75 in fines for garbage cans being left out. Lynda D was asked to research the homeowners past fines.

17310 NW Lapaloma Dr. Issue closed – Tree has been replaced.

16853 NW Arizona Dr. New homeowner is asking to be able to leave Black trim paint around the garage. Homeowner has been given a notice to correct but they bought the home in that condition.

President’s Report: Construction on the new play structors is underway

Treasurer’s Report: Sunil and Tom are looking into a different bank for the HOA Accounts – They will present more information at the next board meeting or over email

Committee Reports:

Social Committee: Community Garage Sale date June 5th, Ice cream social will be on August 21st and Cathy P. is still waiting on information about the July 4th celebration.

Landscape Committee: From a email forwarded from Lynda Dulong – Now that Spring is officiallly here Carolyn Benedict and I took a walk of the common areas and this is what we found the needs attention.

1. Missing shrub on the east side of single fir, east edge of the development along West Union, just east of Oak Creek Dr.

2. No tree, only a stump, midway between Oak Creek and Palmbrook, along West Union.

3. Pruning of shrubs needs to be done. ( John, I can walk with you to point out the exact shrubs).

4. Lawn needs moss treatment.

5. One stump/no tree just west of Palmbrook along West Union.

6. Dead shrub next to fir tree, midway between Palmbrook and Laidlaw, along West Union. Plus there is a tree stump in the sameflower bed. Looks like it needs an evergreen like the others along West Union.

7. Orange flag in flower bed. along West Union, that has two fir trees ans is across sidewalk from Verizon power boxes.

8. Arbor Ridge momument on the east side of Laidlaw looks like it needs a few more flowers. When looking directly at the momument, to the left in front the 3 laurel buses, there is an empty space that needs something. Flowers like are already there would be nice.

9. We question the type of evergreen that has been planted as a replacement, just west of Laidlas along West Union. It looks like a “christmas tree and does not match any other evergreens in the area. We do not believe it is the right tree for the area. We aresuggesting that it be replaced by one more like the type that is all along the entire development on West Union.

10. Just to the east of the above tree is a spot where a shrub that matches the one on the other side is needed.

11. Arbovita is needed in the walkway that is located between 174th and Diamondback.

12. Arbovita is missing on the walkway that has the new black chain link fence that begins at the east side of 174/Laidlaw.

13. Has tree & shrub fertilization begun? If not when will that occur?

14. Wetland area just west of Laidlaw where the Beavers have been working. WE have a question. There appears to have been some “human” cutting of one tree next to the chain link fence. John, can you verify. Also, there is a large pile of tree material , very obvious, out in the middel area. Was that done by Beavers or by humans?

15. This one is directed to the board for directioin. In the same area as mentioned above, we found some “human” trach. I will becontacting the Clean Water people for direction. We believe that the “human” trash should be removed. We will let you know what the Clean Water people say.

16. Graffitti found on the walk way between 174th and Diamond back on the white rail fence.

17. Graffitti found on the end fence post, at the enterance to the walk way from 174/Laidlaw where the black chain link has replaced the white rail fence.

18. Rock break down is occurring along the westland walk way on the east part of the subdivision behind the cottage collectioni.Does this need to be assessed by a structural engineer? This is not new, but is continuing to occur with more large rocks. Our concern is that this type of errosion might compromise the integrity of the wall. Mike, while we were walking today we found a woman walking her two very large dogs, off leash, down in the wet lands behind your home. We spoke to here about the fact that the area was not open to people and animals. She was very rude and actually let her dogs come running up to us. They were very wet and dirty, which appeared to verify that they were down in the water. Not sure what you might want to do. If nothing else, she had her dogs off leash. She told us it was none of our business and acted very defiant. Not sure what one might be able to do. We will walk the cottage collection in two weeks and report our findings then. Consider this as the first report from the Landscape committee for this year. John or Mike, please feel free to contact me for further clarification on any of this report.

4382 NW Diamondback Dr. – Rent sign in front yard, Homeowner wants this allowance and the fines waved. This issue started a long discussion about signage other than a For Sale sign or a Political sign. A motion to table all signage decisions till the board cam make a determination on for Rent signs, Beware of Dog, etc. All Property signs will be noted during this time until the HOA can form a resolution about signs on a homeowner’s property. Motion by John M. and seconded.

17012 NW Oak Creek Dr. – White rocks in the front yard. Homeowner is stated that the rocks have been there for years and the yard is kept well. There is no stated limit on ground cover. Discussion on this issue was that the rocks are uneven and spotty in there coverage. *Secretary doesn’t recall if there was a determination on the fines assessed.

16599 NW Oak Creek Dr. – For Rent sign in the yard. – This issue is tabled till the Board can make a determination on signage in the yard.

17310 Lapaloma Dr. – Street Tree that was missing, $300 fine – This issue will be researched and discussed in the next meeting.

Motion by Dave C. That to toll all fines for alteration to homes color. And Table all Compliance till further notice. Motion seconded.

Meeting was running late and Mike F. called for a close to this meeting due to all remaining agenda items. It was determined that there will be a continued open meeting Monday April 5th to revisit the Administrative items and Homeowner input.

Homeowner had a question about a loud neighbor and what to do about the neighbors loud parties that run into the night. The Association recommended that the Washington County Sheriff’s non-emergency line to deal with the situation. The homeowner in addition should contact TMG so a letter can be sent to the homeowner in violation.

Playground equipment to be added to George Otten Park has not been added yet so Tualitin Hills Parks and Recreation must be waiting till spring to install the new equipment. THPRD have installed a sign noting the changes to the park. More people are signing up to the Arbor Ridge Web site.

Treasurer’s Report

Waiting on year end financial to come in and also looking to get some outside financial advice on changing the way the association is banking. Lynda will contact a financial adviser to attend a meeting. A discrepancy in water billing was reported by the President that it appears a charge may have been applied to the Main Association that should have been applied to the Cottage Landscape. TMG will look into it.

Neighborhood Watch:  John M. has checked the email inbox and has replied to the 2 emails in the inbox but nothing has been replied to.

Social Committee:  The Holiday decorating contest went well this year and Cathy P. had a great time with it. The board suggested some changes and a expansion of the festivities for this year and also suggested that Cathy P. start planning it out now so the word will get out earlier this year. And some other suggestions about having a parade for the 4th of July and other events.

Newsletter:  Mike asked for a volunteer to start up with the newsletter so John M. will start doing the Newsletter this year.

1. Homeowner Correspondence

4457 NW Legend Trail Place – Homeowner has responded to the violation and is requesting that the removal of the fine of $48.74 – After a board discussion a motion was raised to keep the fine in place and this motion was seconded and approved by the remainder of the board

17190 NW Elk Run Drive – Homeowner had a For Sale sign in the front window of the home and given a $75 fine for the violation. Homeowner requested that the fine be removed due to the homeowner being on vacation. Motion was raised to keep the fine in place and this motion was seconded – Board voted to keep the fine in place.

4312 Diamondback Drive – Homeowner has been given a $75 fine for lawn maintenance issues homeowner is in attendance and discussed the situation to the board. Motion to wave the fine was raised by C.P. and seconded – board passes the motion to wave the $75 fine.

16687 NW Tucson St. – Homeowner would like the $75 fine removed for lawn maintenance violation. In a letter of response the homeowner explains that his lawn is now different than the common area next to his property. D.C. motioned that the fine remain and this was seconded and the board passed this motion.

17162 NW Mesa View Lane – Homeowner replied to the board that they would like the $75 fine removed since they have a contractor working on the lawn. But due to soil being mostly clay that this is delaying the results. S. L. motioned to keep the fine in place and C.P. seconded the motion. The board voted to keep the fine in place.

16976 NW Mesa view Lane – Homeowner responded to the violation with information that the lawn is doing better and Tom W. confirmed that there has bee improvements on the property. After discussion C.P. made a motion that the board will wave the fine as long as there is no citations within the calendar year of 2010 and the motion was seconded and the board voted to waive the fine on the condition that if no other citations would be issued the fine will be waved.

2. Compliance Report / Trash Cans

Trash cans were back up to about 80 s/b 50 cans left out past Thursday morning. After discussion if the can tagging was working or not the board seemed to be thinking that the tagging was working as long as after the second time there was a letter sent to the homeowner. Hopefully the numbers will drop again soon. Violations were not given out during the holidays but that seemed to lead to a spike in left out cans. Currently notes on left out cans and after 2 notes a letter will be sent out that will be the ongoing process unless another change needs to be discussed.

Financial

1. Delinquency Report – Currently the delinquent homeowners are just adding late fees to there fees owed. No additions to the information provided in the report.

2. Spectrum Year End Statement – Waiting for the independent auditor to hand in the report.

Repairs and Maintenance

1. Fence Update – Currently all fencing has been cleaned and or replaced.

2. Monument Lights – The sensor has been checked out and should be working correctly. Cathy noted that the West side Monument the middle light seems to be out or very dim.

3. Graffiti – All fence and wall graffiti has been removed – Cathy P.noted that there is still green paint on the sidewalk where the new wire fence was put in place. Also – graffiti is now on the Clean Water Signs which reside in the Wild Area between Laidlaw and 174th. They can be purchased from Clean Water dept at $8.00 a piece instead of having the graffiti cleaned off.

Unfinished Business

Neighborhood walk with the board – tentatively looking at spring time as a good walk around time.

Looking into having Tom include Moss/paint/and clutter around the home as a addition to his other duties as compliance officer.

New Business

4068 NW Klino Springs – $75 violation was charged to homeowner for yard maintenance. After discussion C.P. motioned to keep the fine in place, the motion was seconded and the board passed to keep the fine in place.

Cathy P. recommended that the new trees that Showplace replaced should be marked with a ribbon so we can track that they survive this next year. TMG will follow up with Showplace

Arbor Ridge Home Owners Association Meeting – November 16th 2009

Meeting was called to order at 7:15pm 11/16/09

Meeting Minutes Approval – September 28th Minutes are approved by the board

President’s Report – No formal report this meeting, Mike did mention that Tualatin Valley Parks and Recreation will be installing new park equipment in George Otten Park. Lynda did bring up that the Monument lights are still on in the daytime and that the park basketball court is still very soggy around the edges and on the North side of the court especially and this is the case even during late summer.

Committee Reports –

Social Committee – Cathy spoke about having the Holiday lights contest with giftcards for 1st-$100, 2nd-$50, and 3rd-$20 prizes. To announce the contest Cathy wanted to mail out a One sheet mailer to the community and also provide other information like the Website and Neighborhood Watch. Tom W. mentioned that bulk mailing rates may be available for the community mailing so he suggested that bulk mailing be looked into.

Neighborhood Watch – Information will be added to the mailer for the Holiday lights contest.

Landscape Committee – Mary was not in attendance so the floor was open for general discussion. Lynda brought out a sign specifically to inform garbage can violators a friendly reminder that their cans were left out too long. A lengthy discussion about how long holiday lights should be left out after a holiday was discussed and a consensus seemed to be a February 1st time line for winter holidays and two weeks after any other holidays.  Walking bridge has new graffiti so Showplace will be notified. Also the grass is encroaching the bridge – Showplace will be notified. Grounds that have soil problems will be resolved for $700. Irrigation near wetlands had a breakdown of the costs but Lynda said they didn’t equal the total amount so she will respond to showplace to resolve the cost breakdown.

Management Report – Lynda went over the violations report and specifically the responses to violations from Homeowners.

*Please note Tom W. in the capacity of compliance committee officer did not vote yea or nay on any motions pertaining to affirmation or waiver of fines in any compliance cases.

Large shrub between the homes on Gold Canyon is over grown the width of the allowed space and is over hanging both driveways and the sidewalk creating a safety issue. A $75 fine has been imposed and the homeowner responded by cutting back the shrub and asking that the fine be waived due to compliance with the request to correct the violation. A motion was then proposed that the fine be waived conditionally as long as the homeowner properly maintained the care of the shrub. This motion was amended to simply waive the fine since the homeowner complied with the request to correct the violation.

4295 Diamondback Dr. Request to waive fine, after Tom W. went over the history of this homeowners chronic violations. Discussion of this homeowner’s violations and reactions to reminder letters lead the board to motion that the fine will not be waive in this case.

4199 NW Chaparral, homeowner has not responded to the requests to correct so a motion to keep the fine in place was voted on and passed.

4368 NW Diamondback Drive has no shrubs in the front of the home. Tom W. explained that the homeowners removed the plantings. and it turns out that the homeowners moved and took the removed plants with them. So the new homeowners have no idea that they should have plantings in front of the home. This exposed a glaring issue for the CCR information packet since it is vague on the appearance of the homes in the classic and cascade collections. There is no mention in the CCRs about the number of plantings that should be in front of the home.

17003 Tucson – Basketball hoop is left out in the front yard and is not in use since the backboard glass is broken out.  Tom W. went over the violations and Homeowner asked to have fine waived, after discussion and since the homeowner has done nothing to repair and remove the basketball hoop from the front yard a motion was proposed to keep the fine in place. This motion passed the board vote.

16919 Tucson – Tom W. described the violation in detail. The basketball hoop and stand are not used and in disrepair. The net won’t stay on the hoop due to damage from abuse. The garage door for some reason has a rust stain down the front of it and this issue has not been corrected properly. After discussion that the homeowner has done nothing with the basketball hoop and has not corrected the garage door stain this homeowner will continue to be reviewed by the compliance committee.

16971 Mesa View – Homeowner has not corrected a lawn issue and asked that the fine be waived, no corrective action has been noted. Motion to keep the fine in place was voted on and passed.

Fence modifications report – Estimates have been received and after lengthy discussion it was determined by the board to put a cap on monies spent on the project and to give Mike F. the authority to make a final decision to hire a company to remove the white fence and replace with the cyclone fence to help resolve the graffiti issue at that location. Board voted to let Mike F. take over this decision with a $5,000 cap on expenses.

New Business – Tom W. explanation of compliance to the CCRs will be posted to the website. Board agreed with the changes over email so the document will be on the website for homeowners to view.

II. Meeting Minutes for July 27th, 2009
Discussion from dave C. about clause into CC&Rs This discussion was about rental unit caps which would require a community vote of 2/3rds majority to pass, this ended the discussion of the topic.  Sunil had a question about the 70k in outstanding fees for cottage collection landscaping fees.

With the previous changes to the July minutes, the minutes willl be approved.

III. President’s Report – None this meeting

IV. Treasurer’s Report (July, August 2009) – Considerations to roll funds into a CD and this prompted Tom W. mentioned that NW Bank would be willing to work with the association as a financial consultant.  Nick was asked to get in touch with NW Bank to have a rep attend the next meeting.

V. Committee Reports –

Landscape –

– Scrub replacement will start in October when the rains start in the Cottage Collection
– Common Area was walked
– Fur tree on Laidlaw is leaning severely and will have to be replaced (South of Oakcreek)
– Lawn on Oakcreek – Replacement is setup – this one replacement has been board approved
– Arbor Vida in various locations around the property is dying out for some reason, Showplace is paying for the Arbor Vida that is one year old. Spraying will cost $2,400
– Cutting level of Arbor Vida was discussed and decided that the height will be the same as the Cedar good neighborhood fence
– Irrigation hoses and lines should be inspected and checked to make sure they are working.
– West Union rhododendrons should be clipped in a uniform manner.
– Mini rose bushes will be pulled due to lack of proper care.
– Lights on Monument were on at 9:30am – sensor should be checked.

Arbor Ridge Home Owners Association Meeting

The meeting came to order @7:00pm

Present: Lori  Constant, Sunil Luhadia, Tom Weyenberg, Dave Cummings, Mike Farris, Cathy Parson

And Nick Horn from TMG, Mary Davis from the Landscape committee

Approved the minutes from the last meeting.

President Report – address in the Mgt Report – things for the board

Treasurers Report – nothing

Landscaping fees – 70K of outstanding fees

Discussed mailing out a coupon book in which you break it down and pay at your own rate – this would deviate from the semi annual.  Nick indicated we must consider the cost of the books at $3.00 – $5.00 per book.  We need to consider higher late fees if we do start a book.  Nick will get the cost of the books and email the board – it is very common among other associations.

Mary spoke regarding Landscaping:  many cottages have lost plants and need replacing

She has considered 5 gal vs 2 gal.  Also there is a 2nd spot in front of the homes which look like a Diamond shape – and it has utilities or something in the section and we may want to consider ground cover or river rocks because the lawn needs replacing.

Tom brought up the fact we need to look at the Classics and set a precedents due to the fact many lawns are not maintained and have weeds.  Mary brought up the concern that many homes who’s backyards are not maintained and should also be sent a letter

As we have in place for trash cans.

Mary brought up the concern regarding Rock Walls thought out the development we need to have an inspection behind the homes – she will get John to look at them.  Her concern is due to the fact the Wet Lands have rocks which have fallen and split. Another idea

We should be able to pull out the original plans and contact the Architech. We may

have somewhat of a guarantee or warranty

The board authorized Mary $5,000.00 for the plants needed for the Cottage Collection

And the Common Area – this motion was made by Dave and Lori had 2nd the motion.

This will happen in October due to the fact it is too hot now.

Social Committee:  Cathy indicated the Garage Sale announcement with the Cards may have been easily lost in the stacks of mail each person receives or the mail carrier may have lost them.  She checked with the Bulk Mailing Post Office downtown and provided

Station numbers to call according to your zip code.  Many people have complained that

Mail has been lost.  The Garage Sale signs more noticed more than the cards – she found

Around 25 homeowners participated out of 500 homes.

Ice Cream Social:

$500 from Showplace will sponsor the event.  Requested TMG to Split the Cost of

The Park and Rec Vehicle for the kids – $395.00 along with cards or giveaways .

Mike had volunteered to get a sign for the Board and members signed up to

Participate at the Ice Cream Social along with sign up sheets for others within

The community to participate.

Compliance VS  Non- Compliance:

There needs to be a uniform standard to the lawns which are not maintained.  People are now being cited for mold and paint chipping – noticed the North side gets the most mold.

It was discussed that to reduce the number of violations we should have a mailing or some form of information to the people to read referring to the type of violation letters – however; the problem is that we are asking the people to read and many do not read the literature we mail  – we have the violation letters which states the number to call with questions to TMG and TMG can then refer them to the web site.

It was also discussed about RV’s , Boats, Motorcycles since the weather is nice – the vehicles are allowed to be in front for 48 hours.  Then you will be cited if parked repeatedly.

Mike spoke about Communication in order to save time and effort these are the people

We need to communicate directly to for the following issues:

Mary – Landscaping

Tom – Violations

Mike – any other issues which are out of the norm

Another discussion which was brought up is Rental Units – the concern is with the number of properties converting to rentals will the value of homes go down.

Tom will head up committee to research this and see if homeowners have a concern in this area.   Tom indicated we have a responsibility to every unit.  At this time we have 17-19% rental Units if we have a 25% – this will have a direct impact to the valuation to the property.  We must look out for the community.  To move forward Tom’s idea is to pick a group of units in the community a statistical representation and if the idea is positive to move forward with door to door canvassing to sign a proxy into affect.

Dave added we would then need to put a clause into our CC&R’s, in accordance to the by-laws

Tom asked Nick for a list of property of Homeowners who have rentals and Tom will see if there is a correlation of who are on the list of Non-compliance.  Tom could then have visibility into absentee homeowners.

Neighborhood Watch:

Cathy indicated the Crime Prevention Unit will be attending the Ice Cream Social. Tom will talk to John to form some questions.

Financials:

Nick had indicated there are 4 delinquent addresses on the report.

Spectrum Authorization:

Releasing Information – Tom made a motion to sign off and Dave had 2nd it.

Reserves:

Nick had indicated we are ok in our Reserves.

The Boulders throughout the Community we should have John look at the retaining walls to see how stable they are.  Dave mentioned we should look at the plans and who had signed offoon them and what the warranty is for the walls.

Lori indicated she will be stepping down from the Board.  September we will meet one more time and October should be our Annual Meeting.
