Arbor Ridge HOA Meeting Minutes May 18th 2009

May 18th Arbor Ridge Homeowners association meeting.

Attendance: Mike Farris, Dave Cummings, Cathy Parson, Tom Weyenberg, Lori Constant, Sunil Luhadia, John Michaud, Nick Horn

Homeowners input before the meeting is called to order:

– Question about tree trimming, homeowner was unclear about how high off the curb to trim his tree so he trimmed it up 9’ all around. Tom W. was asked to clarify the issue. And in summary Tom explained that 12’ is the clearance that is required by the county according to the mailing that the county sent to those residents that are receiving the slurry seal on their street this summer.

– Letters went out from TMG about tree trimming but some homeowners were confused and felt that the letters were vague and also felt that they were somehow in violation.

– In the ensuing discussion about the letters and the message on them discussion changed to looking into having Showplace (John) write up some landscaping care tips so they can be incorporated into the website and on the landscape committee’s mailer about what they are looking for in there inspections.

– Another homeowner was asking about Greenspace/Wetland issues. Apparently the grass is getting high in next to the walkways and also looking into new plantings etc. Since Mary wasn’t in attendance the questions will be tabled and Nick will follow up with the homeowner once his questions are addressed.

Review of the March Minutes – Minutes were approved by the association

Treasurer’s report – Questions on some line items that Nick walked Sunil through and the rest of the association.

Committee Reports

Landscape Committee – The fire damage on West Union was mention and will be covered in the Management report. Also a question about wetland trimming was mentioned and Nick will contact John at Showplace about this issue, and tree limb trimming in the wetland areas as well. Notices of violations went out and Nick included some letters of response that will be discussed in the management meeting.

Newsletter Committee – Cathy has sent out a preliminary newsletter in email and is looking for more to add in. The ice cream social is set for August 22nd and she needs people to work it. Also we will be handing out proxies at the social. Cathy also proposed that a we have a neighborhood garage sale this summer. A suggestion that someone try and find out how the Stoller Farms community garage sale went and how they had a reality company sponsor it.

The slow children playing signs in the street and bike ramp were discussed at length and determine that since it is a public street and the parent’s responsibility to watch their children there isn’t much the HOA can do about it.

Architecture Committee – Homeowner was notified by the county that a flag (Sidewalk section) was in violation of code and ordered to replace the sidewalk section within a certain time frame. The association decided to have John at Showplace go out and evaluate the tree and see if the root can be removed at the cost of the homeowner. Ni ck Horn will put John in contact with the homeowner.

This issue will be a model for the website informing the homeowners that they are responsible for the sidewalks in the case of uprooting or other damage not caused but utility companies needing access under the sidewalks etc.

Management Report – Nick asked about a homeowner’s violation about patio furniture on a front porch. Tom did the write up and explained that there was so much furniture on the porch that it blocked the doorway on the porch and that is why he had a violation sent to the homeowners.

Nick brought up a proposal to amend the CC&Rs which is to start having a Hearing policy for homeowners in violation so we can get there perspective on the issue. This would not include hardship issues like out of state owners.

Letters included in the meeting packet –

Lucy Lou (Address unknown page 24 of meeting packet) homeowner has an issue with the front lawn, homeowner is working to resolve issue and asked that the since there working on a corrective action they would like the fines rescinded. A motion was brought up to hold the fees until it was determined that the issue is resolved or not by the homeowner. This motion passed.

16876 Oak Creek Dr – Homeowner is unemployed and moved his family to San Diego for a new job – Rental property that owes dues from January and has been paying in installments until recently. After discussion a motion was formulated, to wave late fees and that the balance owed will be due July 1st. And the July payment will move to a 6mth payment plan. – Motion passes.

4331 NW Diamondback Dr. – Planting issue next to the driveway, letter with intent to lean was issued. After discussion a motion was formed and homeowner must pay the Intent to lean ($35) and the other fees will be waved. Motion passes

17310 NW Laploma Ln – Missing tree in front yard for many months – Motion to resolve in 15days passes the board due to the extended time in violation.

4101 NW Chaparral – Owner is requesting that fine be removed for violation with CC&Rs regarding a mattress and other trash in the side yard. Request has been denied since the trash has not been removed.

Director workshop was mentioned to the members of the HOA – Saturday May 30th An all day event.

Nick Horn reminded the Association that the largest accounts that owe dues have gone to the attorneys for further investigation.

Bank account that is approaching $150,000 has now been moved into a new account to keep the Associations accounts under the $150,000 mark. Also some discussion that the possibility the bank could wave there fees due to the large amount of dollars that the association has with the bank. Cathy wanted this investigated and will call the bank to find out if this is an option.

Nick want to remind the association to keep a look out for how utility companies treat the landscape as they work and if any damage occurs it is helpful that the correct utility is identified so that Nick and team can track down the utility to have them resolve damage issues that they cause on Arbor Ridge property.

Fence fire – After some discussion it was determined that the insurance should take a look at the damage and give the association a time line for resolution.

New Business – No new Business

Association walk was discussed but no solid times we firmed up in these discussions. Nick will email the members when a time for this is reached.

Arbor Ridge HOA Meeting Minutes March 23rd 2009

Arbor Ridge HOA board members in attendance: Dave Cummings, Tom Weyenburg, Cathy Parson, Sunil Luhadia, John Michaud, Nick Horn – The Management Group

No Homeowner input prior to the meeting –

Meeting was called to order at 7:05pm

–          Call to approve the meeting minutes for 9/22/08 – approved by the board

–          Call to approve the meeting minutes for 1/26/09 – approved by the board

President’s Report – Mike is on vacation this week so no presidential report.

Treasure’s Report –  1st quarter – no changes

Committee Report – From Mary

–          Lawns are looking bad, there is a lot of Moss and other issues with most of the lawns in the neighborhood.

–          Cottage collection front yards have settled and the lawns are more difficult for John (Showplace) to maintain because of this issue.  Also there may be a safety issue with the yards getting below the level of concrete.

–          Many shrubs have not weathered the winter well and have been damaged. John (Showplace) has suggested that he could cut the damaged shrubs to 8-10” and see if they will re-grow on there own.

–          Mary was wondering if they is or could be a mandatory minimum of shrubs and trees for the cottage collection.

–          Mary noted that at 16895 NW Oakcreek Dr. that half the front lawn is missing.

–          And the landscaping at the monument is not very good. (This issue was addressed and it is being taken care of this week. John was told to wait till the monument work was completed.)

–          Mary wanted to point out that the paint on the homes is looking bad and this should be included in the violations for homeowners. And Tom had commented that this will be looked at in future appearance violations.

–          Discussion on the street work on Diamondback by the county was lengthy and to summarize here that an estimate from John (Showplace) will be pursued for the cottage homes on Diamondback since the general consensus is that the board would rather have John do the tree trimming in preparation for the road work instead of the county.  Those homeowners not in the cottage collection are responsible for there tree trimming or the county will do the trimming for you.

–          Mary also mentioned that the Cottage homes as rentals will be an issue as more become rentals. Nick stated that due to the economy that we may see more homes for rent. Mary wanted to know what the board is prepared to do about this situation – the general thought is that there isn’t much that we can do about this situation.

–          More discussion on if there is money budgeted for tree trimming etc. and that there was some monies set aside. John from Showplace will be asked to give an estimate of costs for landscaping and tree trimming for this season.

Nick Horn –

– Rescheduling of May 25th meeting has been rescheduled to May 18th

Compliance report –

–          Violations have grown and only a few have responded to the violations.

–          Tom brought up some new discussion on Hose and Reel issues that he has been noting as he is noting violations.

o       Hoses out in the front yard and driveways for months

o       Unsightly hose and reel installations on side of homes

–          Asking other board members there opinion about having these types of issues added to violations.

–          Portable basketball hoops have been noted on the street and sidewalks and this seems to be a violation and a safety issue. After discussion it was approved that a homeowner could be notified about the basketball hoop placement.

–          Rent signs – The CC&Rs allow only 1 For Sale sign on a property and 1 Political sign on a property. For Rent signs are not allowed.  Nick asked if Tom would do inspections on Mondays for this so a letter of violation could be sent and received by the homeowner around Thursday or Friday to take the sign down. And this violation will be included in the compliancy report.

Nick Horn –

–          Further discussion on modified payment plan for Cottage homes that are having a hardship applying the landscaping costs. Those homeowners must call the Management group and set up a payment plane with them.

–          Homeowners with high outstanding dues that were sent to the attorneys to be processed, expect an update on progress reports around April 20th.

–          Monument work is officially completed and the landscaping can now be reworked.

New Business –

–          Cathy presented a rough draft of the latest Arbor Ridge newsletter. The board took a moment to look over the information.  In light of suggestions to Cathy, Tom suggested that the homeowners that get violations can be directed to the Arbor Ridge website to a electronic form of the CC&Rs that Tom suggested be posted on the website. So that the homeowners can seek clarification on why they were in violation of the CC&Rs.

Dave called for adjournment and this was seconded – Adjournment was at 8:35pm

Arbor Ridge HOA Meeting minutes January 26th 2009

Homeowner input –
Signs for this evenings meeting were not in the same locations as previously – Need a sign at Oak Creek and West Union was identified as a prominent location.
Garbage bins are being left out too long.
Suggestion that someone check over the neighborhood at 10pm to see if properties are in violation of the CC&Rs

Meeting called to order at 7:09pm
– Review minutes for September 2008 meeting. – Review was tabled till next meeting since minutes were not included in this meetings notes.
– Presidential Notes – No new notes for this meeting.
– Treasure Notes – No new notes for this meeting.
– Committee Reports
– Landscape committee – Homeowner mentioned that utility work was performed on West Union and Oak creek and the workers left the grass at that location damaged.
This was around the October/November time frame. Concern is in the sprinklers in that location and the condition of the grass.

– Social committee –  Cathy will be taking the lead on the Social committee, Cathy suggested that the Board was involved in the Ice Cream Social, also having the Proxy ballots at the ice cream social and information about the neighborhood watch as well. Also possibly having the Newsletter sent out more often like quarterly.

– Management report – Board looked over the extensive compliance report and delinquent payment lists. In discussion about the homeowners that owe over $1,000 he board decided to make a motion to move these properties over to a legal firm of Barker and Martin to proceed with collections of these debts owed.
Monument rebuild update – The masonry is almost complete and the signage was being duplicated to replace the damaged ones. Progress was delayed dut to the recent weather.

– Graffiti issue – Discussion about how to address future incidents at this location. suggestion to remove existing fencing and replace with chain link (cyclone) fencing. One homeowner was attending the meeting and the board asked if this person would speak to the other affected parties to see if they would be open to the change in this fencing and possibly sharing the cost of this change. Board asked the management company to look into various quotes on removing the existing fencing, replacing the fencing and cost of the chain link fence installation.

– New business – Discussion on dues geared toward the Cottage homes. Possibly a change in the payment schedule for the cottage homes and breakup the landscaping dues to a quarterly payment plan.  The Management group cautioned that the board may not want to single out one group of homeowners. And that flexable payments is an option if you call the management group. Also there could be an amendment to change how all homeowners make due payments.

Noting the time the discussion was halted and a call for adjournment was asked and this meeting was adjourned at 8:28pm

July, 28 2008

Board Members Attending:

Kathy called the meeting to order at 7:05 PM.

Comments from Owners

A house on Diamondback is not cutting their lawn and the homeowner had not seen evidence that TMG is addressing complaints.  Fines are not working we need to do more.  Need to check with Nick to see what is going on.  We discussed having more volunteers to review yard conditions.

Meeting Minutes

No comments to minutes.  A motion was made and approved to accept the April 28 meeting minutes as written.  (Note:  HOA did not have May or June meetings.)

Treasures Report

No report.  Discussed issue on sprinklers along West Union Road.  We still need a proposal from Showplace to determine how we want to proceed.  This may require budgeting for next year to do an upgrade.

Committee Reports

No official reports.  Discussed mowing of wetlands.  Questioned whether we paid for work that wasn’t authorized.  Discussed dead arborvitae along wetlands that need to replaced.

Social Committee

Lori will send email asking for help with an ice cream social.  She will ask John from Showplace to make a donation.  Discussed who we might get to donate popsicles – still to be determined.

Management Report

Administration

  1. Compliance Report – discussed how we do compliance.  Lori proposed we have a committee.  Lori has not been able to get a report on compliance from TMG.  Kathy will contact Nick on this.
  1. A motion was made and seconded not to waive late fees at 16722 NW Arizona.  A discussion ensued about being consistent from one request to another.  The motion was withdrawn.  A new motion was made and seconded requiring any request to waive fees be presented by the requestor at a board meeting prior to its consideration.  The motion passed unanimously.

  1. The 2008 budget was discussed including the need for a revised reserve study.

  1. Meeting dates were discussed.  A motion was made and seconded to meet every other month, meetings in February, April, June, August, October and December.   The motion passed unanimously.

Financial

Delinquency Report – reviewed.  Question for TMG, do liens need to be refilled of do they last forever if not satisfied?

Repairs

The repair of the monument was discussed.  When we get a proposal from the insurance company we will need to have a board meeting to discuss and vote on the offer.

Home Owner Input

  • Started Home Owner Input @ 7:01 pm

  • What are the fees for Landscape Maintenance Program for the Cottage Collection and the General Association fees go?  And can a home owner opt out of the landscape program fees?
    • It was explained by the Board and Management company that you can not opt out of the fees.  The Landscape Program fees for the Cottage Collection are applied strictly to the landscaping for the home owners property.  This is part of the agreement signed when the home was purchased.  There are similar charges in both budgets and financial reports but one is strictly for the home owners property in the Cottage Collection and paid for by the Landscape Maintenance fee and the other charges on the Main association are paid with the General Association Dues that all home owners pay and cover the common pieces of property.  The only way to opt out is to have a community vote that would require a 75% approval of all homes that would modify the CCR’s and rules and regulations.

  • Is there a Policy on Political Signs?
    • The signs are considered temporary like a Realtor sign.  However if there was an excessive abuse of signs then it would be addressed with the home owner.

  • What happened to the Monument Sign?
    • The Sign was part of an accident involving a single car.  The Association is working with police to recover repair costs from the driver that ran in to the wall.  Repair will begin after we have worked with the Insurance carrier for the driver.

  • Will the box elder bugs along Oak Creek be sprayed again this year to control them?
    • The board will discuss during new business of the meeting as to what action to take
  • Are there rules for backyard fireplaces?
    • There are no rules as a backyard is a private place.  If there are some problems it suggested the homeowner speak to the neighbor and if it can not be resolved then contact the management office and a friendly reminder to the homeowner will be mailed to let them know that they may be effecting the livability of the neighborhood.

  • Does anyone know there is a homeless man wandering the park?
    • The police are aware and have been contacted before.  However the park belongs to THPRD and is considered sovereign territory.  It is best that anyone observing problematic activity that they contact the Sheriff Dept so they can investigate.  The non-emergency number is available on our web site.

    • Landscape report was presented and reviewed by the board.  It was noted that there are several Verizon lids that are broken and Damaged and that Verizon should be called to replace.
    • Blackberries need to be sprayed
    • Path has been sprayed to kill off weeds
    • Plants between homes are inconsistant in size and should be evened out.

    • The Number of compliance letters are about the same as the previous month
    • 16993 Mesa View has not plan submitted a plan to correct violations as requested at the 2/25/2008 Meeting, TMG will follow up again with homeowner.
    • Showplace contract was presented to the board to sign.  An increase of about 3.5% is being asked due to fuel and bark-dust price increases.
      • The Board also reviewed a BID for landscaping and found that showplace is still competitive in their pricing.
      • Motion made to amend the clause #7 second sentence and have it removed.
      • Motion Seconded, Motion Passed
    • Speed Bump Request on Oak Creek drive
      • Less then 300 cars traveled through the Radar zone set up.  The average speed was 19mph and the max was 31mph.  The report from Washington County suggested that no further action be taken since there the first stage revealed little need to take action.
      • The Report will be sent to the Homeowners who requested a Speed Bump

      • Motion made to accept bid of 4500 for Alpha Ecological.

    • Bid from REX is 15846 cottage & 8340 common
    • Bid from Showplace is 14500 cottage & 4400 common
      • Motion made to accept bid for 18900 from Showplace.

  3. Arborvitae
      • Motion was made to keep Arborvitae no taller then the first gutter line and to continue to trim on normal schedule, but to allow them to grow to that max height.

  4. Landscape Committee
      • Motion made to empower the Landscape Committee to manage the landscape contract as usual, and any costs outside of the scope of the contract needs approval by the board.  In addition all communication of action needs to be copied via email to all the board for review.

  5. Sprinkler Repairs
    • Upon activation 19 heads, 1 timer, 3 nozzles were replaced in the Common Area
    • 50 heads, 2 timers and 60 nozzels were replaced in the Cottage Collection

      • Board agreed that spraying should be done to prevent the spread of the bugs.

      • Alternatives should be looked at including possibly the replacement of the trees with trees that would not attract the bugs.

Home Owner @ 16580 nw Oak Creek – concerned about the number of vehicles parking on and off property at 16550 nw Oak Creek.  Vehicles are parking on landscaping and destroying the sprinkler system  and vegetation that is maintained by the Landscape budget.  It was noted to the home owner that this has been and is being addressed with that home owner.  The Home Owner should be responsible for the damage done to the property. (Pictures where given to TMG).

Home Owner @ 16593 nw Oak Creek – inquired about the addition of the speed monitoring box placed on Oak Creek, that it was not placed in the right area to monitor the problems around the eastern bend of the street to NW West Union.  Home Owner is asking to have Washington County relocate the speed box.

Home Owner @ 16593 Oak Creek – Also inquired about having garbage and recycling cans monitored on a weekly basis on Thursday after pickup to ensure they are properly stored after pickup.

    • Nick printed a full copy of the compliance report dating back to day one with TMG to see if there are any established patterns we should look at.  Future reports will be only recent activity unless requested otherwise.

    • Nick suggested we may want to look into legal action on delinquencies over $3000.  The board was in agreement and asked that this be looked into.

REPAIRS & MAINTENANCE

  1. Speed Bump Installation

    1. Enforce the removal of the Realtors signs per the CCR’s.  Home Owner brought in five(5) realtor signs that are directional signs to a property for sale.  The CCR’s state that only a single sign may be placed in the home owner yard.  Temporary signs for open houses have been allowed.
      • ACTION TMG: How can we communicate to Realtors to abide by the CCR’s is there a way that TMG can communicate this.
      • We will attempt to contact Realtor’s to pick up signs and give them seven days to pick them up or they will be disposed of.
    2. Missing HOA Meeting Sign on NW Oak Creek
      • Board believes that former board member Ken has the sign, and will get Joey in contact with him to pick it up.

      • Vehicles parked on parts of yard and landscaping damaging poossibly the sprinkler system and planting being maintained as part of the Landscaping Maintenance Fee.  Dilibert damage will not be covered as part of the Landscape maintence fee and will be the Home Owner’s responsibility.  There was another concered home owner could not attend due to illness to discuss
      • ACTION TMG: Please look into this property and the possible damage being done.  We believe this may be a rental and the Home Owner needs to be contacted

    1. More Graffiti on path from Laidlaw to Tucson has occurred
      • ACTION TMG: What would it cost to have Showplace monitor and clean it up?

    4. Can we have a speed bump on the round corner of Oak Creek coming off of West Union
      • Home Owner is working already with Washington County on the problems that plague this section of Oak Creek.  They wonder if a speed bump could be added to the street to slow people down around the corner.
      • ACTION TMG: Please research and see what is required and what it would cost to have a Speed bump added to this area.

Cathy – Field Mowing did showplace complete the whole project and get paid for the entire amount?  Nick will work with Showplace on an adjustment.

Mary  – Creating a Landscape Committee, that would help manage the common area and cottages and working with showplace to maintain the areas.  This is not related to compliance.

This related to old business to be discussed tonight in the creation of the landscape committee.  We need to have Mary put together a proposal of the committee.  Per TMG, things they do is help solicit bids for Landscape contracts also.

Discussions on 16993 Mesa View and the fines due. will discuss during Old Business.

Cathy has asked Nick (TMG) for Compliance type totals per month by month Trend Analysis.  Nick will look in to it.

Lori has indicated that we are seeing an improvement in compliance issues.  There are very few repeaters and most issues are resolved between reports.

Vehicle Towing

Mike – Do we need to post a company towing sign

Nick (TMG) – We need to notify the community, then post notice of who is the towing company.  We would need to do this.

Dave – The section Alternatively … we can post a notice 72hrs in advance.

Indicates that doing this we could be impacting non residences as they are not aware of the location issues.

Nick (TMG) – is stating that we can tow without tow signs, but we could have legal challenges.

Lori brought up a situation of a Mecrury Mountaineer parked on the street that has not moved, it is on a public street and on the compliance report.

As it is a public street and Washington County should be involved.  TMG should refer home owners to contact Washington County to report abandon vehicles when they are on public streets.

The Board has decided not to pursue any changes in Towing Policy as it has not be evident that this is a problem on the few private streets we have.  The CCR’s address this and there is no parking signs already posted.

Arbor Homes / West Hills Signs

Nick is still researching for a contract, West Hills can not locate but is also researching. It is know that there was an 18mo contract to allow the placement of the Arbor Homes Sign for a fee, but it is unknown of the start and end date.

Cathy – believes and the board agrees that since no contract can be found that it should be removed.  Some home owners are concerned that it can detract from our home property sales.

Nick (TMG) will follow up with West Hills and tell them the sign should be removed.

FINANCIAL

Delinquency Report

Three delinquent accounts currently.  This number has gone down over the year.

2006 Audit Status

C&M Needs a signature for us to receive the copies.

West Hills was to do it 11/30 but due to weather they were unable.  They will return when the weather clears.

16993 Mesa View Fines

The board has rejected a request to reduce or eliminate the fines for non compliance.  Home owner has not resolved the issues before making the request nor has he provided a plan to correct the issues.

MOTION – Defer giving him another notice to correct and TMG will communicate that fines stay in place and home owner should provide a plan within 60 days to TMG to fix the compliance issues.  If he  fails to provide a plan in 60 days to resolve these issues when the weather allows for the items to be resolved, TMG has been instructed to continue to enforce the Fine Resolution and resume the process.

17310 LaPalma Tree Removed

Home owner did receive a Compliance Letter about the dead street tree and removed it.

The Board has asked TMG to send a letter to home owner to find out when he will replace it with a like tree.

Nick (TMG) will follow up with communication to the home owner and let them know they need to file an ARC form and that they can talk to showplace for assistance in choosing the right tree.
