List of Resolutions
An HOA Resolution (or Board Resolution) is a formal, legally binding decision or rule enacted by a Homeowners Association’s Board of Directors.
While a community’s core legal framework such as the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) and Bylaws establishes the board’s legal authority, resolutions are used to establish specific operational policies, enact administrative procedures, or clarify ambiguities within those overarching governing documents.
As a reminder if you are renting your home, it is the homeowners’ responsibility to educate and enforce the Governing Documents with your renters. Ultimately, you are responsible for your home and your renters’ actions, including notices and fines incurred by your renters.
Pursuant to Section 7.1 of the Bylaws of Arbor Ridge Homeowners Association (the “Association”), the Board of Directors (the “Board”) is given the power to adopt rules and enforce compliance with the Bylaws, Declaration, and CCRs, in accordance with ORS 94.630.
9) Rubbish and Trash
No lot, open space, common property, street or alley shall be used as a dumping ground for trash or rubbish of any kind. All garbage or other waste shall be kept in appropriate sanitary containers for proper disposal and out of public view. Yard rakings, debris and dirt resulting from landscaping work shall not be dumped onto streets, open, space, common property, alleys, any lot or adjacent property.

Pursuant to Section 7.1 of the Bylaws, the Board shall have the duty to enforce this rule, amended as follows:
No lot, open space, common property, street or alley shall be used as a dumping ground for trash or rubbish of any kind. All garbage or other waste shall be kept in appropriate sanitary containers for proper disposal and out of public view. Yard rakings, debris and dirt resulting from landscaping work shall not be dumped onto streets, open, space, common property, alleys, any lot or adjacent property.
Garbage and recycling containers may be placed at the street curb on the day BEFORE pickup day and ON a pickup day.
Containers must be from the street curb before the end of pickup day and must be stored out of public View.
If necessary, owners/occupants are suggested to get assistance from their neighbors to avoid having their containers out and visible on non-collection days.
NOW, THEREFORE, IT IS RESOLVED THAT:
This policy shall replace any previous policies regarding governance of sanitary container storage. A copy of this Resolution Will be distributed to all homeowners at their last known address on file with the Association.
CERTIFICATION OF ADOPTION
The president and Secretary of the Association hereby certify that the foregoing Resolution is a true record of a resolution adopted by the Board at a meeting of the Board of Directors held on July 20, 2022 in accordance with the Bylaws of the Association
