List of Resolutions
An HOA Resolution (or Board Resolution) is a formal, legally binding decision or rule enacted by a Homeowners Association’s Board of Directors.
While a community’s core legal framework such as the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) and Bylaws establishes the board’s legal authority, resolutions are used to establish specific operational policies, enact administrative procedures, or clarify ambiguities within those overarching governing documents.
As a reminder if you are renting your home, it is the homeowners’ responsibility to educate and enforce the Governing Documents with your renters. Ultimately, you are responsible for your home and your renters’ actions, including notices and fines incurred by your renters.
The Arbor Ridge Homeowners Association Board of Directors according to the Declaration and By-Laws, has
the authority to make and enforce reasonable rules governing the properties, in addition to, further defining or
limiting, and where specifically authorized hereunder, creating exception to those covenants and restrictions
set for in this Declaration. Such rules shall be binding upon all Owners upon receipt. Notice shall be given to
Owners 30 days prior to effective date of enforcement.
Therefore it is now resolved that the Board has adopted the following rules with regard to basketball equipment:
- Portable Basketball Hoops are allowed in the community under the following conditions:
a. Portable hoops may not be placed in the street
b. Portable hoops may not block driveways
c. Portable hoops may not block sidewalks or trails
d. Portable hoops must be in good condition, including nets, hardware and bases
e. Weights used to support the base must be in similar good condition
i. Leaking or split bags of sand or rocks are unacceptable
f. Use of portable hoops shall be restricted before 8:00 AM on week days and 10:00 AM on weekends
g. Use of portable hoops shall be restricted after 10:00 PM every day - Portable Basketball Hoops on properties in the Arbor Ridge No. 2 (Cottage Collection):
a. Shall be removed by the owner/resident from maintained yards prior to contracted landscaping work
i. The Landscaping Service is not responsible for moving or working around objects left in or on the maintained areas of the landscape
ii. To avoid damaging basketball hoop equipment, the landscaping service will avoid areas around hoops left in the lawn
b. Shall not be placed on the lawns or parking strips for extended periods of time (greater than 48 hours) causing the browning or killing of the lawn
i. Damaged lawns or lawns that violate the “maintenance of landscaping in an attractive, neat, orderly, trimmed and cut condition at all times, free of brush, weeds, and debris and in compliance with the Street Landscaping Plan” will be considered a violation of the compliance with the CC&Rs
ii. It is incumbent upon the Homeowner/Resident to address and maintain any areas of landscaping that is damaged or disorderly because of equipment left in the area of landscaping service
This change to the use guidelines for the Arbor Ridge Homeowners Association will be formally effective
December 1st, 2012.
